The petitioner complains that the private respondents who were her tenants have been evicted by reason of a decree in several civil suits. After possession was handed over to the petitioner through the Court Bailiff the private respondents are stated to have forcefully entered into the said property afresh. The petitioner has prayed for further relief from the Civil Court seeking possession.
It is also submitted that the petitioner has been threatened by the private respondents from time to time to sell the property at a throwaway price. The petitioner has lodged a complaint with the police. No copy of the complaint has been served on the Narkeldanga Police Station. The Narkeldanga Police shall act on the basis of the complaint at 'Annexure P-11' page 181 of the writ petition and take appropriate steps, inter alia, to protect the petitioner.
The execution case pending before the Civil Court, Sealdah shall be disposed of as expeditiously as possible but not later than a period of one month from date.
The Bailiff shall assist the Executing Court once again to deliver vacant and peaceful possession of the property back to the petitioner.
The Narkeldanga Police shall render all assistance to the petitioner in retaining possession of the property, in accordance with law.
The petitioner may also engage security guards to ensure that the private respondents do not enter into the property again.
With the aforesaid directions, the writ petition is disposed of.
There shall be no order as to costs.
The report of the Additional Officer-in-Charge, Narkeldanga Police Station, dated 26.07.2022 is taken on record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
