The substituted petitioner Basudeb Hati is the son of the original writ petitioner, namely, Bimala Hati, who herself was the wife of deceased employee, Manohar Hati.

Pursuant to a decision of the Co-ordinate Bench dated 12.12.2016 passed in WP 14630(W) of 2000, the deceased original petitioner, Bimala Hati received pension on account of her deceased husband from 21st December, 2013 till her death. The original writ petition was itself filed for the purpose of receiving lifetime pension of Manohar Hati with effect from 1st April, 1995 upto 21.12.2013.

The Director of Pension, Provident Fund and Group Insurance, Finance Department, Government of West Bengal has already issued a communication to the Treasury Officer, Bishnupur recording entitlement and asking for nominees of the pensioner, Basudeb Hati, who is the recorded legal heir.

The Treasury Officer, Bishnupur Treasury shall, therefore, disburse the said lifetime arrear of pension of late Manohar Hati to the legal heirs of Bimala Hati in equal share being Sikha Sarkar, Ranit Sarkar, Sulekha Kongar, Sreelekha Dutta, Basudeb Hati, Manju Metta and Rita Kongar being the substituted petitioner nos. 1(a) to 1(g) within a period of two months from the date of communication of a copy of this order.

For the aforesaid purpose, the substituted petitioners in each of them shall communicate particulars of their bank accounts to the concerned Treasury Officer. Transfer of the share of the respective nominees shall be made immediately upon receipt of bank particulars of such nominees.

The nominees who do not furnish bank particulars shall not be paid until such particulars are given. Those, who infact furnish bank particulars shall be paid by the Treasury Officer.

Let the aforesaid exercise be completed within a period of two months from date.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.
