Kausik (Allowed) CRM (NDPS) 862 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nowda Police Station Case No. 284 of 2024 dated 25th of October, 2024 under section 21(C)/29 of the NDPS Act, 1985;

Learned advocate appearing for the petitioner submits that the petitioner happens to be the owner of the vehicle who has been implicated in connection with the instant case. The recoveries were from the possession of the driver and the helper. 10,000 bottles have been recovered.

However, the case diary do not connect any materials which would reveal that the owner of the car had any relationship with the consignment which was being carried by the driver and the helper.

Learned advocate appearing for the State has produced the case diary. There are statements of co-accused which are appearing.

Be that as it may, having considered that the petitioner is in custody for 7 months, I am of the opinion that further

detention of the present petitioner is unwarranted as he is differently situated from other accused persons who are in custody.

Consequently, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Chiran Debnath shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court under NDPS Act cum Additional Sessions Judge, 5th Court at Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date fixed by the learned Special Court. Petitioner shall not leave the jurisdiction of District of Murshidabad without the permission of the learned Special Court.

Accordingly, CRM (NDPS) 862 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
