The petitioners and the private opposite party no.2 have entered into an amicable settlement in respect of the dispute which cropped up and for the purpose of which criminal law was set into motion and Alipore Police Station Case No. 38 of 2022 dated 19.04.2022 was registered for investigation under Sections 420/406/120B of the Indian Penal Code.

The said report encloses the statement of the authorized representative of the complainant-company as well as a communication made to the Officer-in-Charge, Alipore Police Station for withdrawing the criminal case. Having regard to the nature of the dispute which cropped up, I am of the opinion that in view of the amicable settlement arrived at between the parties, further

continuance of the proceedings is redundant and continuance of the same would result in harassment of the present petitioners as well as the complainant. Accordingly, all further proceedings arising out of Alipore Police Station Case No. 38 of 2022 dated 19.04.2022 corresponding to CGR 1094 of 2022 pending before learned Chief Judicial Magistrate, Alipore are hereby quashed.

Thus, the revisional application being CRR 2396 of 2023 along with the CRAN 1 of 2023 is allowed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
