28.07.2022 UL/SL ns/pg Ct.16 MAT 1111 of 2022 With I.A. No.CAN 1 of 2022 Kavita Jaiswal.

Vs.

Designated Committee, Kolkata North Commissionerate & Ors.

Mr. Akshat Agarwal .... for the appellant.

Mr. Uday Sankar Bhattacharya, Mr. Sukalpa Seal ... for the respondents.

This matter has been listed under the caption "To Be Mentioned".

It is pointed out that in pages 4 and 5 of the judgment and order dated 26th July, 2022, the benefit of status quo which the appellant had been enjoying pending writ petition was directed to be continued. However, noting the submissions made by the learned Senior Standing Counsel for the respondents, the order was restricted.

The learned advocate appearing for the appellant requested that the order may be suitably clarified so that the interim protection continues till the writ petition is taken up by the Learned Single Bench.

In the light of the above, the last paragraph of the judgment and order dated 26th July, 2022 is modified as hereunder.

Since the appellant had the benefit of order of status quo pending writ petition, the respondent authorities are directed not to take any coercive action against the appellant till the writ petition is taken up for hearing by the learned Single Bench. We give liberty to the learned Advocate appearing for the appellant to mention before the appropriate learned Single Bench for early listing of the writ petition.

This order shall form part of the judgment and order dated 26th July, 2022.
