It is submitted on behalf of the petitioner that she has been occupying flat no. B-1/16 in S.K. Deb Road, L.I.G. Housing Estate and has deposited rents for the same till 31st December, 2021. The petitioner intends to shift to a flat in one of the lower stories of the building on health grounds and filed an application dated 26th March, 2021 to that effect before the Estate Manager, Estate Directorate, Ex-officio Secretary, Housing Department, New Secretariat Building, Kolkata, requesting the authority to allot a flat in her favour in one of the lower stories of the building in place and stead of her present accommodation which is located in the fourth floor of the building. The petitioner complains that her application has not been considered by the authority

till date. It is submitted on behalf of the State that the application of the petitioner shall be considered by the authority at the earliest.

Upon consideration of the submissions on behalf of the parties and material on record, the writ petition is disposed of with a direction upon the second respondent to consider and dispose of the application filed by the petitioner dated 26th March, 2021 within a period of one month from the date of communication of this order, after affording reasonable opportunity of hearing to the petitioner. The third respondent should consider the application of the petitioner sympathetically and after giving due consideration to the medical documents annexed to the application by the petitioner.

With the aforesaid observations and directions, WPA 16523 of 2021 is disposed of. However, there shall be no order as to costs.

Since no affidavit has been invited, the allegations contained in the petition are deemed not to be admitted.
