Affidavit of service filed in Court today be kept with the records. Despite service none appears on behalf of the Jangipur Municipality.

The writ petition was filed challenging the construction of a pavement with steel barricade infront of the shop of the petitioner situated at Fultala, Post OfficeRaghunathganj, District-Murshidabad. It is submitted that pursuant to service of the writ petition, the barricade in front of the shop has not been removed. Pictures have been produced before this court which show that no such obstruction to the entrance of the petitioner's shop exist.Thus the court is of the opinion that no protective order is required to be passed at this stage.

The Municipal authorities have taken care that the entrance to the shop room of the petitioner, is not blocked in any way. The further prayer of the petitioner for the change of alignment of the pavement cannot be entertained as this step has been taken for public interest

and such actions of the authorities for public good and beautification should not be interfered with.

The grievance of the petitioner has been addressed. The ingress and egress to the shop is free.

However, it is made clear that the entrance of the petitioner's shop shall remain as it is and further obstruction should not be placed in front of the door, blocking free entry and exit from the main road. This writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
