This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge, Junior Division at Bidhannagar to dispose of Title Suit No. 328 of 2024 expeditiously. Learned Advocate for the petitioner submits that the application for temporary injunction is still pending. From the order sheet appended to this application, this Court finds that an ad interim order of injunction was passed on October 8, 2024 and 27th June, 2025 was fixed for hearing of the injunction application and for acceptance of the written statement.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party. However, the learned Advocate on record for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned Advocate representing the opposite party before the learned Trial Judge.

In the light of the submissions made by learned Advocate for the petitioner, CO NO. 2447 of 2025 stands

disposed of by requesting the learned Civil Judge, Junior Division at Bidhannagar to take up the hearing of the application under Order 39 Rules 1 and 2 of the Code of Civil Procedure on the next date fixed, if the same is otherwise ready for hearing, and shall make all endavours to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the application for temporary injunction and other interlocutory applications, if any, the learned Trial Court shall make all endavours to dispose of the suit as expeditiously as possible.
