The petitioner is aggrieved that certain auto rikshaw permit holders under route no. 279 are plying on route no. 137 in which the members of the writ petitioner are permit holders. The writ petitioner has complained to the Regional Transport Authority at Alipore but in vain.

This Court is of the view that petitioners'

grievance is against the RTA which cannot be entertained before this Bench. Narendrapur Police Station to which the complaint has been addressed shall, however, forthwith ensure that there is absolutely no breach of peace in the area or in route no. 137.

The petitioner and/or its members shall be entitled to make appropriate representation to the RTA, Alipore giving better particulars of the violations alleged by the said permit holders concerned. The writ petition is disposed of.

There will be no order as to costs.
