Mr. Arup Kumar Bhowmick ...for the petitioner Mr. Suman De Mr. Amanul Islam ..for the State Learned counsel appearing on behalf of the petitioner submits that there is no other material available against the present petitioner except for the statement of co-accused which is inadmissible in evidence.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He refers to the case diary and submits that the petitioner was named in the FIR. He had fled away from the spot. Moreover, he has got criminal antecedents. Considering the incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
