The revisional application was preferred against the order dated 28th May, 2009 passed by the learned Judicial Magistrate, 1st Court, Malda in case no. 683(M) of 2005(T. R. Case No. 2079 of 2005) under Section 125 of the Code of Criminal Procedure. As the order under challenge was passed in the year 2009 and there was no interim order in respect of the order passed by the learned Magistrate, I am not inclined to interfere with the impugned order at this belated stage. However, if there are change of circumstances, the petitioner would be at liberty to take out an application under Section 127 of the Code of Criminal Procedure drawing the attention of the learned trial court to the change of circumstances, which would be considered by the learned Magistrate in accordance with law. With the aforesaid observations, the revisional application being CRR 2496 of 2009 is disposed of.
