Affidavit-of-service filed on behalf of the petitioners is taken on record.

Authority of Nandkumar Jeevanrao STPN High School, Purba Medinipur (hereinafter referred to as 'said school') has come up with this writ petition for one student, who is presently studying in class X of the said school seeking permission to take admission in another neighbouring school in class X for participating in Madhyamik Pariksha (Final Examination) 2026.

Fact remains said school obtained recognition as four class Junior High (from classes VI to VIII) and in this regard Convener and Member, State Level Committee

for Recognition of Private unaided Schools & Joint Director of School Education had issued memo dated 5th June, 2025. Therefore, indisputably the said school has recognition up to class VIII and not beyond that. 4.

Court is surprised to find out that the said school runs classes IX and X without obtaining order of upgradation from the concerned State authorities from four class Junior High to High School and till date said school has not been upgraded to a High School. Therefore, said school does not have authority to permit any student to attend classes IX and X; question of permitting a student of class X of said school to take admission in another neighbouring school does not arise.

If students are studying in class IX or class X of the said school, those students are required to take admission in a recognized high school, in accordance with law.

Said school authority is directed not to run classes IX and X till school is upgraded from four class Junior High to High School.

With the aforesaid observations and direction writ petition stands disposed of.
