C.R.R. 2187 of 2005 Sri Sanjoy Roy Kuntia versus Smt. Kakali Roy Kuntia In Re: An Application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973.

The present revisional application was preferred challenging the order dated 04.05.2005 passed by learned Sub-Divisional Judicial Magistrate at Bolpur, Birbhum in Misc. Case No. 08 of 2005 wherein the learned court was pleased to grant interim maintenance of Rs.450/- per month to the wife/opposite party herein.

I have perused the order dated 04.05.2005 passed by the learned Sub-Divisional Judicial Magistrate at Bolpur, Birbhum in Misc. Case No. 08 of 2005 and on an assessment of the factual application made by the learned Magistrate in arriving at a quantum of Rs.450/- per month by way of interim maintenance, I am of the opinion that the quantum so awarded is a meagre amount and was passed for maintenance of the lady during the pendency of the main application under Section 125 of the Code of Criminal Procedure.

Having regard to the said quantum and the change of circumstances which have taken place so far as expenses are concerned and the cost index, no interference is called for.

Accordingly, the revisional application being CRR 2187 of 2005 is dismissed.

All pending connected applications, if any, are consequently disposed of.
