The petitioner being aggrieved by the order dated 26.03.2025 passed by learned Additional Chief Judicial Magistrate, Kandi, Murshidabad, has preferred the instant application. By the impugned order learned court below has issued warrant of arrest against the petitioner after rejecting his prayer for adjournment.

It is submitted on behalf of the petitioner that petitioner obtained anticipatory bail from this Court in CRM 10907 of 2018 and thereafter he is attending the Court. However, by the impugned order learned court below arbitrarily rejected his prayer for adjournment and issued warrant of arrest against him. Now, the petitioner intends to surrender before the court below.

Mr. De, learned counsel, who usually appears before the court on behalf of the State is hereby appointed to represent the State. Concerned authority is directed to regularize the appointment of Mr. De.

Having heard learned counsel appearing on behalf of the petitioner and the State, the instant application being CRR 2958 of 2025 is hereby disposed of giving liberty to the

petitioner to surrender before the court below within a period of two weeks from this date and in the event of such surrender by the petitioner before the court below, the court below will dispose of his prayer in accordance with law without being influenced by any observation made hereinabove. The impugned order dated 26.03.2025 by which warrant of arrest was issued against the petitioner is stayed for a period of two weeks or till the petitioner surrenders before the trial court, whichever is earlier.
