The petitioner's application for transfer on medical ground (serious gynaecological problems) has not been decided upon by the School Service Commission, despite passage of significant amount of time, and many of the vacant posts preferred by the petitioner being filled up.

It appears from the records that the Head of the Institution has forwarded the petitioner's application to the District Inspector of Schools (SE), Purba Bardhaman, who has in turn recommended the same to the School Service Commission.

The issue is as to whether the petitioner's medical condition has been verified from the BMOH by

the Head of the Institution and CMOH by the District Inspector of Schools (SE), Purba Bardhaman.

In view of the above, the School Service Commission, after verifying all the records of the petitioner and ensuring compliance of Transfer Rules, 2015, shall take a decision on the petitioner's application for transfer in accordance with the Rules within a period of one month from the date of communication of a copy of this order.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
