Re: CRAN 1 of 2010 (Old No. CRAN 2218 of 2010) (an application under Section 5 of the Limitation Act) Learned advocate appearing for the petitioner prays for condonation of delay of 270 days in preferring this revisional application.

The reasons so assigned in paragraph 6 of the application for condonation of delay relating to illness of the petitioner (Hepatitis-B) are found to be just and sufficient. Accordingly, delay is condoned. The application being CRAN 1 of 2010 (Old No. CRAN 2218 of 2010) is, thus, allowed. Re: CRR 1874 of 2010 The subject matter of this revisional application relates to an order dated 05.06.2009 wherein the learned Magistrate was pleased to close the evidence of PW-1 and fix date for examination of the accused under Section 313 of the Code of Criminal Procedure.

I am of the opinion that by efflux of time, the contention advanced in this revisional application has become infructuous.

Accordingly, the revisional application being CRR 1874 of 2010 is disposed of.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
