The writ petition was preferred as the representation of the petitioners dated 13.06.2024 was not considered by the Inspector-in-Charge, Sagar Police Station. The dispute as is reflected from the representation related to the cultivation in respect of certain plots of land.

State has submitted a report after conducting enquiry which reflects that at the relevant point of time when there was a dispute and difference between the petitioners and the private respondents, police authorities drew up proceedings under Sections 107/116 of the Cr.P.C. There is an issue relating to demarcation of land and, as such, police authorities have restricted themselves by keeping a sharp vigil over the situation to maintain peace and tranquility.

In view of the limited role of the police authorities in case of private dispute, I am of the view

that police authorities acted in consonance with the provisions of law, as such, no interference is called for. Parties would be at liberty to approach the appropriate forum for necessary reliefs.

With the aforesaid observations, WPA 16408 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
