Affidavit of service so filed be kept with the record. The grievance of the present petitioner is that the private opposite party/wife is appearing on the dates so fixed for the execution case, but is not available for evidence when the miscellaneous cases is posted before the learned Magistrate. Both the cases are before the same court. Accordingly, henceforth the learned Judicial Magistrate, 2nd court, Barrackpore is directed to fix M. Ex Case No. 67 of 2021 and the evidence of M. Case No. 634 of 2019 on one and the same date. The learned Magistrate would while acting as a trial court fix regular dates along with the execution case so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, the present revisional application being CRR 2403 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
