Petitioner Mr. Apalok Basu, Mr. Abhijit Sarkar ...For the Petitioner The petitioner seeks expeditious disposal of CNS-387 of 2019 under Section 138 of the Negotiable Instruments Act, 1881, pending before the learned Metropolitan Magistrate, 20th Court, Calcutta. It has been submitted by the learned advocate for the petitioner that after the plea was recorded on March 25, 2021, there has been no effective progress in this case.

In this pandemic situation, it cannot be expected that the learned Magistrate in the Court below shall proceed with the case at a normal pace.

However, keeping in mind the innocuous nature of the prayer made in the petition, this application is disposed of with a direction upon the learned Magistrate in the Court below to make an endeavour to conclude the trial of the case without granting any unnecessary adjournments to the either of the parties.

Since the opposite party no. 2 shall not be prejudiced by this order, this application is disposed of without any notice upon him. Accordingly, CRR 2070 of 2021 is disposed of. (Kausik Chanda, J.)
