The petitioner being aggrieved by the inaction on the part of the respondent concerned in considering and disposing his reply dated 30th August, 2021 in response to the notice of the respondent dated 24th August, 2021.

Considering the submission of the parties this writ petition being No. WPA 16583 of 2021 is disposed of by directing the Deputy Commissioner of State Tax, Bhabanipur Charge, respondent No. 2 herein to consider and dispose of the reply/representation dated 30th August, 2021 as appears at page 27 of the writ petition in accordance with law and by passing a reasoned and speaking order and by giving an opportunity of hearing to the petitioner within four weeks from the date of

communication of this order and to communicate its decision to the petitioner within one week thereafter. In case the petitioner does not appear without any reasonable justification on the date of hearing of the aforesaid writ petition the respondent concerned will be entitled to pass ex parte order.

With this observations this writ petition being WPA 16583 of 2021 is disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the applicant upon compliance of requisite formalities.
