Learned advocate for the petitioner submits that the petitioner is the complainant in a case under Sections 498A/406/34 IPC being Ballygunge Police Station Case No.30 of 2019 dated 06.03.2019.

Petitioner is not inclined to proceed with the case as there have been change of circumstances.

Petitioner is directed to serve a copy of the revisional application upon Mr. Ali, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.

Having regard to the context under which the petitioner intends to withdraw the criminal case being Ballygunge Police Station Case No.30 of 2019 dated 06.03.2019, I direct that such an application be preferred before the learned Judicial Magistrate. The learned Judicial Magistrate will consider the same by keeping in

mind that the subsequent changes do not create any hardship to the parties concerned.

With the aforesaid observations, CRR 2404 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of such requisite formalities.
