1. The petitioners have filed this public interest writ petition not objecting to the implementation of the new water supply scheme project but would suggest that the location of the overhead tank should be so located that the water supply is uniform for the entire area.

2. Firstly, these issues cannot be gone into in a public interest writ petition and these should be left to the decision of the experts.

3. As per the report given by the Executive Engineer, Raiganj Division, Public Health Engineering Department, certain objections were raised by way of a mass petition and it appears that the Pradhan of Birghal Gram Panchayat has insisted to start the work immediately.

4. Learned advocate for the petitioners submitted that his clients have reliably come to know that the authorities are now contemplating of shifting the location of the overhead tank.

5. As observed earlier, these are all matters, which have to be dealt with by the authorities and while doing so, the authorities shall be guided by the principle that the project should serve the general public to the fullest.

6. With the above observations, the writ petition is disposed of.

7. No costs.

8. Urgent photostat certified copy of this orde0r, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
