The petitioner is unable to cultivate his land as he alleges that there has been interference at the behest of the private respondents. Earlier the petitioner approached this Court wherein a coordinate Bench in WPA 18444 of 2023 was pleased to hold from the police report that the accusations of the petitioner were unsubstantiated and as such only directed for maintaining law and order so that no breach of peace takes place. The petitioner has again filed a representation. Petitioner's present allegation is that the police authorities are hand in gloves with the private respondents.
State has submitted a report which reflects that the petitioner is hardly available within the
jurisdiction of Sagar Police Station, but usually stays at Namkhana as he is a priest by profession. In view of the earlier directions passed by this Court, no interference is called for in respect of the writ petition. If the petitioner is aggrieved, the petitioner would approach the jurisdictional civil/criminal court. The concerned court would assess regarding the nature of the accusations and pass necessary orders in accordance with law. With the aforesaid observations, the writ petition being WPA 16400 of 2024 is disposed of. There will be no order as to costs.
