On the last occasion, learned counsel appearing for the petitioners was requested to serve the respondent College authority which has been done. The four petitioners were selected for Group-C and Group-D posts in the concerned College situated in Purulia. The Memo dated 13th March, 2020 shows the names of the four petitioners as empanelled candidates for the concerned posts. Recommendations of the Selection Committee to the Governing Body for approval further reflect that the four petitioners held the first position in relation to the concerned panel namely, Lady Attendant (petitioner No. 1), Guard(SC)(petitioner No. 2), Peon(SC)(petitioner No. 3) and Laboratory Attendant for Geography(petitioner No. 4).

Learned counsel appearing for the petitioners places an order of a learned Single Judge dated 12th July, 2021 passed in WPA 8001 of 2021 which

records the submissions made on behalf of the College Authority (the same as in the present writ petition) that by a Memo dated 31st August, 2020, the Governing Body of the College was dissolved and Sub-Divisional Officer, Jhalda, Purulia was appointed as Administrator of the College. Learned counsel submits that after appointment of the Administrator, no steps were taken for appointing the empanelled petitioners and that representation made to the Director of Public Instructions as well as the Administrator by the petitioners on 6th March, 2021 has also not been responded to. In view of the above and the fact that the four petitioners continue to remain empanelled candidates holding the first position in their respective categories and the further fact that the said panel subsists till date, there is no conceivable reason why the Administrator or the Director of Public Instructions failed to take requisite steps for appointing the petitioners to the concerned posts.

WPA 16590 of 2021 is accordingly disposed of with a direction on the respondent No. 5 being the Administrator of the College to act on the representation dated 6th March, 2021 within four weeks from date. It is made clear that since the petitioners were successively empanelled,

expeditious steps should be taken in that regard by the Administrator and without any further delay. The writ petition is disposed of.
