During the pendency of the writ petition, petitioner no. 1 passed away on December 30, 2023.

Since the legal heirs of petitioner no. 1 are already on record, CAN 1 of 2024 and CAN 2 of 2024 are disposed of by taking due note of the demise of petitioner no. 1.

Re: WPA 15449 of 2023 The petitioners have raised a grievance that the West Bengal State Electricity Distribution Company Limited (WBSEDCL) has drawn a high-tension electricity

line over R.S. Dag No. 26, corresponding to L.R. Dag No. 57, under R.S. Khatian No. 24, corresponding to L.R. Khatian Nos. 207 and 335.

The petitioners claim to be co-sharers of the said land.

Learned counsel appearing on behalf of WBSEDCL submits that the high-tension line was laid with the consent of all the brothers of petitioner no. 2. Let the instructions filed on behalf of WBSEDCL be taken on record.

Respondent nos. 11 to 13 are not represented before this Court.

However, it appears from the records that the petitioner made a representation before the Divisional Manager, Jianganj, requesting relocation of the hightension line. In the facts and circumstances of the case, I am of the view that there is no necessity to keep this writ petition pending.

Accordingly, the Divisional Manager, Jianganj, is directed to consider the representation of the petitioners in accordance with law, after affording an opportunity of hearing to all concerned, and to pass a reasoned order within a period of three (3) months from the date of this order.

The reasoned order shall be communicated to all concerned parties forthwith.

Accordingly, WPA 15449 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
