Petitioner is aggrieved by the fact that in spite of the civil court having decided the title in his favour and a portion of the land pursuant to compliances being converted was being processed, resistance was offered by the private respondents and, as such, he could not give effect to the same. Petitioner lodged complaint with the Superintendent of Police, Purba Medinipur Police District.

Police authorities on receipt of such information enquired and submitted a prosecution under Section 126 of the BNSS vide Tamluk PS NCR no.1271 of 2024.

In view of the police authorities having taken steps, I am of the view that there has been some

dispute which has compelled the police authorities to take steps. Accordingly, police authorities would keep a strict vigil and ensure that no breach of the peace and/or tranquility and/or any untoward incident results because of the dispute and difference existing between the parties.

With the aforesaid observations, WPA 16570 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. Needless to state that since no affidavit has been called for, the allegations made in the writ petition are deemed not to have been admitted. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
