Nobody appears on behalf of either of the parties on call.

This is an application pending since 2017. The instant application has been filed by the petitioners under Sections 397/401 read with section 482 of the Criminal Procedure Code, 1973, seeking quashing and or setting aside of the proceedings in connection with G.R. case no. 2825 of 2013 arising out of Alipurduar police station case no. 531/2013 dated 18.11.2013 under sections 406/409 of the IPC, 1860 pending before the learned Additional Chief Judicial Magistrat at Alipurduar and all orders passed in connection with the same including order dated 29.3.2016 whereby the learned Court had issued warrant of arrest against the petitioners.

In spite of giving opportunities, no one appears on behalf of the petitioners. Even on earlier occasion no one represented the petitioners, no accommodation sought for. It indicates that the petitioners are no more interested to proceed with the instant case.

Accordingly, CRR 2027 of 2017 is dismissed for default.

Interim order, if any, stands vacated.

Let the order be communicated to the Ld. Court below for information.
