Case No.307 of 2024 dated 03.12.2024 under Sections 21(c)/22(c)/23(c)/27A of the NDPS Act, 1985. And In the matter of:

Nitai Barman ... petitioner Mr. Sayan Kanjilal ... for the petitioner Mr. Avishek Sinha Ms. Rita Dutta ... for the State Learned counsel for the petitioner submits that apart from the statement of a co-accused, there is no material available against the petitioner.

Learned counsel for the State strongly opposes the prayer for anticipatory bail and relies on the call records showing telephonic conversations between the petitioner and the principal accused on the day before the date of incident. He also points to the statements of neighbours, who stated that the petitioner was seen fleeing away of the place of occurrence when the raid was held.

Considering the incriminating materials available in the case diary as mentioned above and the restriction contained

in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
