The present revisional application has been preferred challenging the continuance of the proceedings being Beniapukur Police Station Case No.275 of 2020 dated 14.07.2020 under Sections 498A/406 of IPC and Section 3/4 of D.P. Act.

During the pendency of the present revisional application there was a compromise and an amicable settlement arrived at between the parties.

Learned advocate for the State has earlier produced documents to the effect that the de facto complainant/opposite party also withdrew the case being M. No.38 of 2020 under the PWDV Act pending before the learned Judicial Magistrate, 6th Court, Sealdah as well as M. Case No.48 of 2020 under Section 125 Cr.P.C. pending before the learned Judicial Magistrate, 6th Court, Sealdah. Today a report has been submitted by learned advocate for the State which encloses a communication

made by Maryam Mohiuddin wherein the lady has communicated that she has restarted her conjugal life. Having regard to the changed circumstances and the report so submitted, I am of the opinion that further proceedings so far as the present petitioners are concerned are unwarranted as the genesis of the case related to matrimonial discord.

Accordingly, all further proceedings of Beniapukur Police Station Case No.275 of 2020 dated 14.07.2020 under Sections 498A/406 of IPC and Section 3/4 of D.P. Act including charge-sheet filed therein is hereby quashed. Consequently, CRR 2407 of 2023 is allowed.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
