Mr. Saibal Acharya, Mr. Arka Bhattacharya ....for the petitioner Mr. Rajib Kumar Acharya, Mr. Banshi Badan Maity ....for the respondent no.6 The petitioner is aggrieved that despite order of status quo passed in T.S. No. 173 of 2021, the private respondent is effecting construction. The same is evident from a report of the Advocate Commissioner appointed by the Court below.

An application under Order 39, Rule 2(a) of the C.P.C. for police assistance is pending consideration before the learned Court below. In those circumstances, this court directs the learned Civil Judge (Senior Division), 1st Court at Tamluk, to dispose of the petitioner's application under Order 39, Rule 2(a) of the C.P.C. filed in T.S. No. 175 of 2021, as expeditiously as possible, preferably within a period of one month from the date of communication of a copy of this order.

The parties shall strictly abide by the order of status quo passed by the learned Court below or as may be modified.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
