Case No. 5887 of 2008 under Section 12 of the Protection of Women from Domestic Violence Act, 2005 pending before the learned Judicial Magistrate, 10th Court, Alipore, South 24 Parganas, the matter may be disposed of without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order of expeditious disposal of the matter.

This Court is informed that the proceeding was instituted on August 08, 2008 and interim order under Section 23 of the Act passed on March 02, 2009. The matter is pending since then and the next date for further cross-examination of the petitioner has been fixed on August 17, 2024.

As the proceeding is pending since long before the learned Trial Court, the learned Trial Court, being the learned Judicial Magistrate, 10th Court, Alipore, South 24 Parganas is directed to take the proceeding to its logical conclusion within one year from the next date fixed before him without granting any unnecessary adjournment to either party, in accordance with law.

CRR No. 2595 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
