W.P.A. 16622 of 2021 (Resu Sk & Anr. vs. Union of India & Ors.) Md. Sarwar Jahan Md. Ashraful Huq Mr. Binoy Panda .... For the Petitioners Affidavit-of-service filed by the petitioners is taken on record.

None appears for the respondents despite service of notice.

The petitioners' grievance is that a portion of the plot occupied by them has been encroached upon by the respondents for construction of a road without acquisition and no compensation has been paid to the petitioners for the same. The petitioners seek liberty to submit a comprehensive representation before the concerned Authority in this regard and pray for a direction upon the Authority to consider the representation at the earliest.

In view of the same, the writ petition is disposed of with liberty to the petitioners to submit a comprehensive representation before the 7th respondent ventilating their grievances within seven days from date. The 7th respondent shall consider and dispose of the representation within two months from the date of receipt thereof, after affording reasonable opportunity of hearing to the petitioners, in accordance with law. The decision taken by the Authority shall be communicated to the petitioners within a week thereof.

With the aforesaid observations and directions, W.P.A. 16622 of 2021 is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
