06.01.2021 rpan / 36 Court No.25 W.P.A. No.16540 of 2017 Abdul Jubbar Shaikh & Others - Versus - State of West Bengal & Others Mr. Ekramul Bari, Mr. S. S. Mondal Ms. Tanuja Basak ... for the petitioners.
Ms. Supriya Dubey ... for the SSC.
Mr. Bari, learned advocate appearing for the petitioners submits that the petitioners participated in the First State Level Selection Test for Recruitment of Assistant Teachers - 2016 in upper primary level of schools. All the petitioners have successfully completed 2-year D.El.Ed (Diploma in Elementary Education) course in terms of the rules and norms of National Council for Teacher Education (NCTE). On the basis of such training qualification the petitioners should be given priority over other candidates who do not have such qualification.
As no one appears today on behalf of the Commission, Ms. Dubey, learned advocate, who is present in Court, is directed to appear on behalf of the Commission. Let such engagement of Ms. Dubey be regularised.
By a judgment delivered on 11th December, 2020, a co-ordinate Bench of this Court had set
aside and cancelled the selection process for appointment of candidates to the post of Assistant Teachers of upper primary schools in which the petitioners participated.
In view thereof, the present writ petition has become infructuous and the same is, accordingly, dismissed.
There shall, however, be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
