The petitioner alleges inaction on the part of the CESC authorities. The petitioner contends that despite several applications having been made for grant of new connection, the CESC authorities failed and neglected to discharge the duties under the law.

Records reveal that the District Engineer, CESC Ltd., Howrah Regional Office had cancelled the prayer of the petitioner on the ground that more than one application has been filed. The petitioner approached the authority by filing a representation through the learned advocate. Long time has lapsed since the authority had taken a decision to cancel the application of the petitioner on the ground that the petitioner had filed multiple applications for grant of new connection.

The writ petition is disposed of with the direction upon the respondent No.2/the District Engineer, CESC Limited, Howrah Regional Office to treat

the writ petition as a representation and dispose of the same upon granting opportunity of hearing to the petitioner. If the petitioner is otherwise entitled to the electric connection, the authority shall indicate the necessary formalities which are required to be fulfilled by the petitioner, for grant of new connection. A reasoned order will be passed and communicated to the petitioner. The entire exercise will be completed within four weeks from date.

A copy of the writ petition along with the server copy of the order be served upon the District Engineer, CESC Limited, Howrah Regional Office for necessary compliance.

5. The entire exercise shall be completed within a period of three months from the date of communication of this order.

All parties are directed to act on the basis of the server copy of the order.
