Heard learned counsels for the parties.

It is not in dispute that the petitioners have been found entitled to compensation for acquisition of their land. Assessment of compensation along with other statutory benefits have not been made as yet.

It is submitted on behalf of the State respondents that compensation along with other statutory benefits be directed to be assessed by the Special Land Acquisition Officer, South 24 Parganas being the 3rd respondent herein, in accordance with law. In view of the above, the writ petition is disposed of directing the 3rd respondent to assess the compensation along with other statutory benefits payable to the petitioners in respect of the plot which is the subject matter of the writ petition within one month from the date of communication of the order. Such assessment be communicated to the petitioners in order to enable them to raise objection, if any.

In the event no objection is raised by the petitioners to the said assessment, the assessed amount of compensation shall be disbursed in favour of the petitioners by the third respondent within three months thereof.

The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
