The petitioner is working in the post of Assistant Teacher in a Government aided High School and has prayed for transfer.

However, during course of hearing, this Court has been apprised of the fact that the petitioner was selected based on SLST, 2016 to be appointed in the post of Assistant Teacher. The learned advocate representing the West Bengal Central School Service Commission submits that entire selection process relating to SLST, 2016 for Classes IX, X, XI and XII has been set aside by the Hon'ble Division Bench and the judgment delivered by the Hon'ble Division Bench has been questioned by preferring Special Leave Petition before the

Hon'ble Supreme Court and the issue is pending before the Hon'ble Supreme Court.

In view of the aforesaid facts, no relief can be granted in favour of the petitioner relating to transfer at this stage.

Accordingly, the writ petition stands dismissed.

However, this order shall not preclude the petitioner to take steps in accordance with law seeking transfer if situation so permits.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
