Since the petitioner seeks expeditious disposal of MP Case No.1346 of 2024 under Section 144(2) of the Code of Criminal Procedure pending before the learned Executive Magistrate, Baruipur, South 24 Parganas the matter may be disposed of without service of notice upon the opposite parties.

Opposite parties shall not be prejudiced if an order for expeditious disposal of the matter is passed in their absence. Expeditious disposal of the matter shall in fact enure to the benefit of both the parties.

Heard learned counsel for the petitioner.

The application under Section 144(2) of the Code was filed on 4th April, 2024 and the matter is still pending. Keeping in mind the tenor of the provision laid down under Section 144(2) of the Code, the learned Executive Magistrate, Baruipur, South 24 Parganas is directed to dispose of the case within one month from the next date of hearing fixed before him in accordance with law.

The revisional application being CRR 2598 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
