(NDPS) 868 of 2025 In Re:- An application for Bail under section 439 of the Code of Criminal Procedure as amended/under section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with NDPS Case no. 100 of 2024 arising out of Raninagar Police Station case no. 647 of 2024 dated 24.10.2024 under Sections 21(c)/29 of the NDPS Act, 1985. And In the matter of : Sariful Molla @ Soriful Molla & Anr. .... Petitioners.

Mr. Tapodip Gupta Mr. Suman Bhanja ...for the Petitioner Mr. Madhusudan Sur Mr. Sarthak Mondal ...for the State Prosecution case is that 449 bottles of cough syrup containing codeine phosphate was recovered from the joint possession of the present petitioners. He further submits that investigation has already been ended into a charge-sheet on 4th April, 2025 and as per charge-sheet prosecution required to examine 14 witnesses but they could not examine a single witness so far and as such it is unpredictable as to when the trial would be concluded and for which they may be released on bail on any terms and conditions.

Learned counsel appearing on behalf of the State opposed the bail prayer contending that commercial quantity of narcotic substance was recovered from the joint possession of the present petitioners and he received instruction that 15th, 16th, 17th September, 2025 are fixed for examination of

prosecution witnesses and as such it is expected that the trial would be concluded within a short span of time. Having heard learned counsel appearing on behalf of the petitioners and the State and that rigour of section 37 of the NDPS Act, clearly attracts in respect of the present petitioners, the prayer for bail is considered and rejected. Accordingly, CRM (NDPS) 868 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
