The revisional application has been preferred challenging the order dated 03-02-2022 wherein the present petitioner prayed for return of the seized vehicle. The Investigation officer of the case filed a report wherefrom it reflected that one Piyarul Islam(accused no.1) who was the principle accused also parted with money for purchase of the said vehicle and was the guarantor while owner of the vehicle happened to be the present petitioner, namely Sujauddin Sk.

Record reflects that the case is of the year 2021. The vehicle is lying for almost three years as there are confiscation proceedings which form the part of the Act, I am of the view that until and unless the vehicle is released on stringent conditions there my be difficulties at the end of the trial when the court come to its finding at the final stages.

Having regard to the same, I direct the petitioner shall furnish bank guarantee of Rs.8,00,000/-(Rupees eight lakhs only)

with the learned trial court. Petitioner would produce the vehicle as and when called for and will not change the nature and character of the vehicle.

With the aforesaid observations, the revisional application being CRR 2560 of 2022 is disposed of. The order dated 03-022022 passed by the learned Judge, Bench-I, Special court, City Sessions court, Calcutta is accordingly set aside. . Pending any other applications, if any, are consequently disposed of.
