Petitioner Mr. Apalok Basu, Mr. Abhijit Sarkar ...For the Petitioner The petitioner seeks expeditious disposal of CNS-22401 of 2017 under Section 138 of the Negotiable Instruments Act, 1881, pending before the learned Metropolitan Magistrate, 3rd Court, Calcutta. It has been submitted by the learned advocate for the petitioner that, case is now at the stage of cross-examination of the authorized representative of the petitioner.

In this pandemic situation, it cannot be expected that the learned Magistrate in the Court below shall proceed with the case at a normal pace.

However, keeping in mind the innocuous nature of the prayer made in the petition, this application is disposed of with a direction upon the learned Magistrate in the Court below to make an endeavour to conclude the trial as expeditiously as possible, preferably within one and half years from date.

Since the opposite party no. 2 shall not be prejudiced by this order, this application is disposed of without any notice upon him. Accordingly, CRR 2073 of 2021 is disposed of. (Kausik Chanda, J.)
