Chakraborty .....for the respondent no. 9 Mr. Shehnaz Tareq Mina Mr. Ranjit Rajak ......for the State The present writ application has been preferred praying for directing the respondent authorities, especially the respondent no. 5 and 6 to comply with the direction and/or communication reiterated by the respondent no. 8, vide letter/s dated June 3, 2021 and June 21, 2021.

It appears that the order/s under challenge have been issued by the Secretary of the Co-operative Housing Society Limited.

Admittedly the tenure of the said board of the Co-operative Society has expired and a special officer

has been appointed to look into the administration of the said Co-operative Society.

The special officer representing the respondent no. 8 is present in Court and has placed an order dated 09.01.2025 passed by the Hon'ble Division Bench in WPA (P)41/2024 where as it has been directed that the special officer in any event "the verification of the credentials of the existing members has to be done by the Special Officer" regardless the fact that Umesh Kumar Singh is agitating the matter before the learned Arbitrator.

On hearing the learned counsels for all the parties and considering the orders challenged in the present case.

The present writ petition is disposed of with the direction that the special officer in the present case shall consider the orders under challenge and also verify the credentials of the existing members in accordance with law.

The writ petition stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Let a copy of this order be sent to the Trial Court at once.

Photostat certified copy of this order, if applied for, being given to the parties on priority basis upon compliance of all formalities.
