The petitioner claims ownership of the said premises and contends that the mutation has been effected without granting any opportunity of hearing to him.

Learned advocate appearing for the petitioner has drawn attention of this Court to a representation dated January 13, 2023, addressed to the Assessor Collector (South), Kolkata Municipal Corporation, respondent no.3 whereby the petitioner raised objection with regard to such mutation.

It has been submitted that till date no response has been received from respondent no.3.

In that view of the matter, this writ petition is disposed of with a direction upon respondent no.3 to consider the representation dated January 13, 2023, appearing at page 26 of the writ petition in accordance with law within a period of three months from the date of communication of this order. Respondent no.3 shall give due notice to all concerned and pass a reasoned order. The reasoned order should be communicated to the petitioner within seven days thereafter.

Accordingly, WPA 16426 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
