The grievance of the petitioner is directed against the illegal and unauthorised construction. It is submitted on behalf of the petitioner that though the initial sanctioned plan granted to the private respondent was to construct a three storied building, the respondent have illegally and unauthorizedly constructed seven storied building. It is also submitted on behalf of the petitioner that the entire construction being carried out by the private respondent is without the authority of law and in contravention of all mandatory compliances.

The private respondent Nos. 5, 7 and 8 are represented and submit that the sanction plan annexed to the writ petition has not been forwarded to them and in fact they have a valid and lawful sanctioned plan for G+5 storied building.

On behalf of the Municipal Corporation it is submitted that they have received the representation dated May 15, 2025 and undertake to dispose of the same expeditiously.

In view of the submission made on behalf of the parties, WPA 15362 of 2025 stands disposed of by directing the respondent No. 2 to consider and dispose of the representation dated May 15, 2025 within a period of six weeks from the date of communication of this order after giving a right of hearing to all the effective parties, in accordance with law and without being influenced by any observation made in this order.

It is made clear that there has been no adjudication on the merits of the case and all questions are left open to be decided by the respondent No. 2.

As affidavits have not been filed, allegations contained in the writ petition are not admitted.
