Heard learned counsels for the parties.

The petitioner is in custody for more than 11⁄2 years and prays for bail.

Learned counsel for the petitioner submits that the petitioner is not involved in the alleged offence and he has not been identified by any of the witnesses.

Learned counsel for the State and de facto complainant oppose the prayer.

I have considered the material on record. It appears that the victim lady is a physically challenged person and has identified the petitioner in Court. The injury report of the victim supports the prosecution case.

This Court is informed that only one witness is left to be examined by the prosecution.

Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
