This is petitioner's application to recall the order dated 31st August, 2023 passed by this Court in WPA/15521/2023.

The order dated 31st August, 2023 runs thus:- "It is frankly submitted by Mr. Saha Roy that after receiving the supplementary report filed by the learned Advocate on behalf of the State respondents the petitioner does not wish to press the instant writ petition. In view of such submission, the instant writ petition is disposed of being not pressed."

Now by filing the instant application it is submitted by the petitioner that he never made any instruction of not pressing the instant writ petition to his learned Advocate.

Be that as it may, the instant order cannot be recalled. However, the petitioner is at liberty to file a fresh writ petition on the selfsame cause of action. (Bibek Chaudhuri, J.)
