1. The appellants are not represented even on the second call nor any accommodation is prayed for on behalf of the appellants.

2. The learned Counsel for the respondents has submitted that the appeal has now become infructuous. The matter was adjourned earlier on 20th February, 2024 in order to enable the appellants to file an application for amendment. However, no such application has been filed till date. It is assumed that the appellants are not interested to proceed with the matter.

3. Under such circumstances, the appeal and the application are dismissed for non-appearance.
