Learned counsel appearing for the petitioners submits that the condition of the tender for furnishing Solvency Certificate on or after 1st March, 2022 by the bidders was not complied with by the private respondent. However, the private respondent was selected as a successful bidder.
After hearing counsel, it appears that the petitioners made a representation before the tendering authority on 29th June, 2022, that is two days after the
disqualification of the petitioners. The respondent authority has, however, not responded to the said representation.
Counsel appearing for the petitioners also submits that the second representation was made before the tendering authority on 14th July, 2022, although this representation does not form part of the record.
WPA 15928 of 2022 is disposed of with a direction on the respondent no. 2 being the Superintending Engineer, North Bengal Construction Circle-II, Public Works Directorate to dispose of two representations made by the petitioners within 10 days from date. A copy of the response with reasons shall be made available to the petitioners within three days from the date on which the representations are disposed of. ( Moushumi Bhattacharya, J.)
