Petitioners are aggrieved by the fact that there has been inaction on the part of the police authorities in spite of registering Dhaniakhali PS case no. 219/2025. Petitioners submit that the accused persons have vandalized their property and they are unable to enter and enjoy the property.

State has submitted a report. Report reflects that the investigation of the case is in progress. Learned advocate for the private respondents on the other hand submits that a decree was passed by the Civil Court but in respect of different set of persons which are not covering all of the respondents.

Having considered that the police authorities are aware regarding the dispute between the petitioners and the private respondents and the fact that a criminal case

has been registered by the police authorities themselves on 5th of July, 2025 and regular incidents are taking place between the petitioners and the private respondents, I am of the view that the police authorities would ensure that no untoward incident further results because of the inimical relationship existing between the petitioners and the private respondents.

It also reflects that Title Suit no. 623/23 was filed against one of the respondents.

Be that as it may, so far as the issues relating to the right, title and interest of the property is concerned, the same would be considered by the Civil Court. However, the police authorities would continue their surveillance and ensure peace and tranquility as directed above.

With the aforesaid observations WPA 15394 of 2025 is disposed of.

Report so submitted by the State be kept with the record.
