The petitioner is aggrieved by the fact that Dum Dum Police Station has not taken any steps to secure a property belonging to the petitioner. The petitioner claims to be both owner and developer of the said property.

Counsel for the PNB Housing Finance being respondent No.6 submits that the purported documents produced by the petitioner do not indicate his title. On the contrary the mortgage of the PNB Housing Finance is strongly asserted.

The respondent financial institutions have pasted notice of possession of the same under the provisions of the SARFAESI Act, 2002.

This Court notices that the disputes between the parties are purely civil in nature. This Court is of

the view that the remedy of the petitioner is before an appropriate civil or statutory forum. The police as of now have no role to play whatsoever in the matter. With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.
