Learned counsel for the WBSEDCL files a report, along with a hand sketch map, indicating that the dispute can be resolved by affixation of a new electricity pole at the corner of the plot of the petitioner Sikha Sinha, on the 'Baram path' of the petitioner, to avoid any inconvenience to others.

The WBSEDCL, fairly enough, has also indicated in the report that, considering the safety perspective, the WBSEDCL will upgrade the total connection line to AB cable in order to obviate any hazard.

Appreciating such fair stand of the WBSEDCL, it transpires that such solution would not enure to the disadvantage of any of the parties.

Hence, WPA 15934 of 2022 is disposed of by directing the WBSEDCL to install the proposed new

electricity pole at the location as indicated in the hand sketch map annexed with the WBSEDCL report and to give the new electricity connection to the petitioner from the said pole as expeditiously as possible, preferably within four weeks from date, subject to compliance of all formalities by the petitioner.

In the event any obstruction is raised to the WBSEDCL personnel in doing so, it will be open to the said personnel to approach respondent no.4, the Officerin-Charge of the Sutahata Police Station for adequate police assistance in that regard.

If such an approach is made, respondent no.4 shall arrange for such police assistance at the cost of the petitioner and provide the same for the purpose of the WBSEDCL personnel to install the said electricity pole and give such connection to the petitioner.

It is made clear that the respective civil rights and contentions of the private parties to the writ petition have not been entered into by this court in any manner whatsoever.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
